What Must I Prove?

When Congress created the National Vaccine Injury Compensation Program (NVICP or VICP), the intent was to have a fast, simple, effective way to compensate victims of vaccine injuries with a minimum of expense, delay, and inconvenience.

The theory was: If you are injured due to a vaccine or how it was administered, simply file a claim, show evidence that the injury was related to the vaccine or vaccination, and in a few months receive compensation.

Unfortunately the claims process has become much more complex, and a much higher burden of proof has been placed on claims filed.

At the present time, to receive compensation, you, as the petitioner, must:

  • Show that you have been injured and the connection between the vaccination and the injury is medically plausible.
  • Show there is a logical sequence of cause and effect between the vaccination and the injury.
  • Show that the injury occurred within the medically appropriate time frame.

That's why substantial documentation, medical and hospital reports, and other materials must be submitted with each claim.
